Acceptable Use Policy

This policy sets out what may be sold or swapped on KASDAQ, what is prohibited outright, how you are expected to behave towards the person on the other side of a deal, and what we do when somebody breaks these rules. It forms part of the Terms of Use and applies to everybody who uses the platform.

1.Who this applies to

This policy applies to everybody who uses KASDAQ — buyers, sellers and anybody swapping a device — and to everything you put on it: listings, photographs, descriptions, messages and your profile.

It sits underneath the Terms of Use and forms part of them. Where this policy and the Terms cover the same ground, the Terms govern. Words defined in the Terms mean the same thing here.

Breaking these rules can cost you your account. Depending on what you did, we may remove a listing, cancel a deal, hold a settlement, suspend you, close you permanently, or report you to the police — and where money or an item is involved, we keep the records.

2.What you may list

KASDAQ is for consumer electronics, and nothing else. You may list a physical device that falls inside one of the categories we publish — phones and wearables, computing, TVs and home entertainment, gaming, cameras and studio equipment, power and solar, and networking equipment.

The category list is ours and is maintained by us. You choose from it; you cannot invent a category, and an item that does not belong in any of them does not belong on the platform. Swap listings are narrower still: the handset must already be in our device catalogue, and a model that is missing has to be submitted and approved before anybody can list it.

  • The item must physically exist, be in your possession, and be the exact unit you photographed.
  • It must be legal to own and to sell in Nigeria.
  • It must be yours to sell, or you must be authorised by the owner to sell it.
  • You must be able to hand it over in person, in the state you are trading in.

We do not sell anything. Every listing belongs to a user, every item is handed over by that user in person, and nothing on the platform is stocked, shipped, inspected or warehoused by us.

3.What you must never list

Regardless of category, the following are not permitted, and listing any of them is grounds for immediate suspension:

  • Stolen, lost or blocked devices — anything reported stolen or lost, blocked or barred by a network or manufacturer, or subject to an outstanding loan, lien or unpaid finance agreement.
  • Locked devices you cannot unlock — handsets still tied to somebody else's iCloud, Google or manufacturer account, or carrying an activation lock you cannot clear in front of the buyer.
  • Tampered identifiers — devices whose IMEI, serial number or other identifier has been altered, removed, cloned or reprinted.
  • Counterfeits and replicas — fake, cloned or knock-off devices, and genuine devices misrepresented as a different model, capacity, generation or brand.
  • Money in any form — cash, bank transfers, cryptocurrency, gift cards, vouchers, airtime, data pins, loyalty points, or any other stored value.
  • Financial products — shares, tokens, investments, loans, insurance, or anything that pays a return. Nothing on this platform is an investment and nothing may be listed as one.
  • Services and labour — repairs, installations, unlocking, consulting, delivery, or any other work. We list goods, not work.
  • Anything that is not a physical device you hand over — accounts, subscriptions, software licences, downloads, in-game items, data, or anything delivered electronically.
  • Weapons and controlled goods — firearms, ammunition, explosives, knives sold as weapons, drugs and drug paraphernalia, prescription medicines, tobacco, alcohol, and any other item requiring a licence we do not hold.
  • Surveillance and interception equipment — SIM boxes, IMSI catchers, signal jammers, covert recording devices sold for spying, decoder-cracking or subscription-defeating equipment, and tools sold for gaining unauthorised access to accounts or networks.
  • Documents and identity — passports, national identity cards, driving licences, certificates, SIM cards registered in somebody else's name, or anything else that establishes who a person is.
  • Hazardous, living or human material — chemicals, swollen or damaged lithium cells sold loose, medical waste, animals, and human remains or tissue.
  • Recovered or scrap electronics sold as working — water-damaged, burnt, salvaged or e-waste stock presented as functioning goods.

Selling stolen goods is a criminal offence. Where we have reasonable grounds to believe an item is stolen, we suspend the account, preserve the listing, the messages and the payment record, and cooperate fully with law enforcement, including by providing identity and verification details on lawful request.

4.Listing honestly

A listing is a description of one specific unit, and the person reading it is about to travel across a city on the strength of it.

  • Photograph the actual item. Stock images, manufacturer renders, screenshots, images taken from another listing and photographs of a different unit are all prohibited. A marketplace listing needs at least two genuine photographs; a swap listing needs all six required angles.
  • Describe the real condition, including the faults. A cracked back, a swollen battery, a replaced screen, a dead face sensor, water history, a network lock — if you know it, say it.
  • State the model, capacity, age and history accurately.
  • Price the item you are actually selling. You must hand over the unit you listed, not a substitute and not a different one of the same model.
  • Certify ownership when you are asked to. That checkbox is a statement you are making, and we rely on it.

For swaps, the handset's IMEI is registered against your listing and checked at the handover, and it is screened against devices already registered here and against our block list. Listing a phone whose IMEI is blocked, or one already registered to somebody else, will be refused.

5.How you must behave

You must not:

  • place offers you do not intend to pay for, or bid to move a price you have no intention of trading at;
  • trade with yourself, or coordinate with another account to create false prices, false volume or a false reputation;
  • run more than one account to get around a suspension, a strike or a referral rule;
  • use another person's identity, bank account or payment details, or let anybody use yours;
  • harass, threaten, deceive, intimidate or abuse another user or our staff, or turn up to a handover with anybody who does;
  • discriminate against another user, or refuse a deal on the basis of who somebody is;
  • raise a dishonest dispute — claiming an item was never received when it was, or that it was faulty when it was not;
  • attempt to access another person's account, data or conversations;
  • scrape, copy or republish listings, prices or content in bulk, or interact with the service by automated means;
  • probe, overload or interfere with the service, or work around any limit, gate or moderation control.

6.Keeping deals on the platform

You must not try to move a deal off KASDAQ. That includes asking for or giving a phone number, email address, social handle or link before a deal is confirmed, asking to be paid directly, offering a discount for paying outside the platform, and cancelling a deal in order to complete it privately.

Listings and messages are screened for contact details, in the text and in the images. A listing that carries them is taken down, and repeated attempts are grounds for a permanent ban.

This is not about our commission. A deal taken off the platform has no protected payment, no record, no handover code and no dispute process. It is the single most common way people are defrauded here, and we cannot help somebody it happens to.

7.Using payments properly

Money moves on this platform for one reason: to pay for a specific device that a specific person is handing to another. It is not a way to move money about.

  • You must not use KASDAQ to send money to somebody for any reason other than a genuine deal for a real device.
  • You must not create a listing, a match or a swap to move funds, settle a debt, collect a payment, raise a donation or invoice anybody.
  • You must not pay from, or ask to be paid into, an account that is not in your own verified name.
  • You must not break a payment into smaller transfers, or use several accounts, to avoid a limit or a check.
  • You must not use the service to launder money, to move the proceeds of crime, to finance terrorism, or for any other unlawful purpose.

Payouts and returns go to the bank account in your own name that we verified against your identity, and nowhere else. We do not pay third parties, we do not pay cash, and there is no balance on this platform that you can spend or withdraw.

8.Messages and content

Conversations between the two sides of a deal are screened automatically, and our support team can be invited into one — or can join a disputed deal — to help settle it. Keep them about the deal.

  • No contact details, links or requests to talk elsewhere before a deal is confirmed.
  • No abuse, threats, sexual content or hate speech.
  • No sending anybody else's personal information.
  • No images that are not of the item, the meetup or the problem you are describing.

9.Meeting safely

Every deal ends with two strangers meeting. Handovers must be arranged at a public meeting point from the list we provide — private homes and residential addresses are not permitted, for the safety of both of you.

  • Meet in daylight, in a busy place, and tell somebody where you are going.
  • Check the item fully before you release the payment. Once you confirm the handover, the money is the seller's.
  • Never give out your handover code before the item is in your hands.
  • If anything feels wrong, walk away and raise it with us. No deal is worth your safety.

10.How we enforce this

Some of this is enforced by the platform itself. Listing text and listing photographs are scanned for contact details; messages are screened; swap handsets are checked against our device register; and identity, bank account and name matching are verified before anybody can trade.

The rest is enforced by us, on reports and on review. Depending on what happened we may remove a listing, cancel a deal, hold a settlement while we look into it, issue a strike, suspend the account, or close it permanently. More than three active strikes inside thirty days suspends an account automatically.

We may suspend or close an account immediately, without strikes and without notice, where we reasonably suspect fraud, dealing in stolen goods, identity misuse, money laundering, or conduct that puts another person's safety at risk.

If you believe a decision was wrong, you can appeal it from your account settings and a person will look at it again.

11.Reporting something

If you see a listing or a message that breaks these rules, tell us. Use the support desk inside the app, or email support@kasdaq.io with the listing or deal reference.

Rights holders reporting a counterfeit, and anybody reporting a device as stolen, should write to legal@kasdaq.io with the details and any reference number. Law-enforcement requests go to the same address.

We may update this policy as the platform changes. The version and the date it took effect are printed at the top of this page.
